Time Limits Increase for Claims to Tribunal

The Employment Rights Bill intends to raise the current three-month time limit for claims to Employment Tribunal to six months.  The pledge was made in the Labour governments Plan to Make Work Pay.

‘We will improve and strengthen enforcement through employment tribunals to provide quicker and more effective resolutions. In line with the Law Commission recommendation in April 2020, we would increase the time limit within which employees are able to make an employment claim from three months to six months, bringing the time limit for all claims in line with the time limit for statutory redundancy and equal pay claims.’

The six months’ time limit will apply to discrimination and unfair dismissal claims changing an employer’s ability to consider a situation resolved at the three-month period and opening up a longer window for an employee to have an external recourse for challenge.
